Federal Judge Blocks DOJ Pressure Tactics Against Election Officials
A sweeping emergency order halts federal efforts to intimidate local workers and interfere with ballot processing.

A federal judge has issued a temporary restraining order to stop the Department of Justice and the Department of Homeland Security from using aggressive tactics to influence election administration. U.S. District Judge Trina Thompson ruled that while the administration claims its actions are intended to prevent noncitizen voting, these measures are likely to disenfranchise lawful voters and disrupt the electoral process. The ruling serves as a significant check on federal efforts to pressure local officials ahead of the midterm elections.
Under the terms of the emergency order, federal agencies are strictly prohibited from demanding that local jurisdictions segregate ballots, purge individuals from voter rolls, or suspend the processing of ballots. Furthermore, the court has explicitly blocked the administration from threatening state and local election workers with criminal prosecution for their handling of voter eligibility disputes. Judge Thompson emphasized that officials performing their duties in accordance with state law do not violate federal criminal statutes, even when processing ballots from voters the administration alleges are ineligible.
The court’s decision directly rebukes months of rhetoric from the administration, which has repeatedly warned that it would pursue legal action against election staff for failing to prevent illegal voting. Election officials have frequently criticized the federal government's lists of suspected noncitizens, noting that the data is often unreliable and incorrectly flags U.S. citizens. The judge’s opinion highlighted that such federal interference threatens to intimidate and coerce those responsible for managing the democratic process.
This legal development follows a broader pattern of judicial pushback against federal intervention in state election procedures. In a separate matter, a federal appeals court recently rejected the administration's attempt to block the counting of certain ballots in California, affirming that the federal government lacks the authority to intervene in state-level citizenship verification. While the Department of Justice has moved to appeal Judge Thompson’s latest order, the ruling currently stands as a major protection for the independence of local election administration.
