Appeals Court Rules Trump’s California National Guard Deployment Unlawful

In a significant legal setback for the administration, a split three-judge panel of the U.S. Ninth Circuit Court of Appeals has ruled that President Trump’s decision to federalize and deploy 4,000 members of the California National Guard last year was an unlawful abuse of executive authority. The court’s 2-1 decision affirms a lower court’s order that had previously blocked the deployment, which was initiated in response to protests against federal immigration policies in Los Angeles.

The administration had argued that the move was justified by a supposed "rebellion" within the city, a claim the appellate court flatly rejected. Judges determined that the president failed to provide sufficient evidence to support such a characterization, noting that the justification did not fall within a "range of honest judgment." By federalizing the troops without meeting the necessary legal thresholds, the court found that the administration violated the constitutional separation of powers.

California officials, led by Governor Gavin Newsom and Attorney General Rob Bonta, hailed the ruling as a major victory for state sovereignty. The lawsuit challenged the administration’s attempt to seize control of the state’s military assets, arguing that the deployment also ran afoul of the Posse Comitatus Act, which restricts the use of military forces for domestic law enforcement. The court agreed that because the troops were not properly federalized, they remained under the legal status of state police.

This ruling establishes a critical legal precedent that limits the president's ability to bypass state leadership when mobilizing the National Guard. The decision follows a similar precedent set by the U.S. Supreme Court last December regarding the federalization of the Illinois National Guard. By upholding the injunction, the Ninth Circuit has effectively closed a pathway the administration sought to maintain for future federal interventions against the objections of state governors.
