Federal Court Dismisses Justice Brunner’s Challenge to Partisan Ballot Labels

A federal judge has officially rejected a legal challenge brought by Ohio Supreme Court Justice Jennifer Brunner regarding state election laws. The lawsuit, which was initiated in 2023, sought to invalidate a 2021 statute that mandates the inclusion of political party affiliations on general election ballots for candidates running for the state supreme court and regional appellate courts.

Justice Brunner argued that the legislation, known as Senate Bill 80, created an untenable conflict for judicial candidates. She contended that by forcing candidates to display their party labels, the state effectively pressured them into political alignment while simultaneously maintaining strict judicial conduct rules that limit their ability to speak freely on political matters. According to the complaint, this combination posed a significant risk to her professional law license.

In her ruling, U.S. District Court Judge Benita Pearson determined that the plaintiff failed to demonstrate that the state law violated the First or Fifth Amendments, or the Equal Protection Clause of the Constitution. The court found no constitutional basis to strike down the requirement that has been in effect for recent judicial election cycles.

Furthermore, the court emphasized the timing of the decision. With the general election less than three weeks away and absentee voting already in progress, Judge Pearson noted that granting the requested relief would disrupt established election procedures. The court cited directives against altering state election rules on the eve of a contest as a primary factor in the decision.

As a result of the ruling, the partisan labels will remain on the ballots for the upcoming November 3, 2026, election. This decision concludes a high-profile legal battle that highlighted ongoing debates regarding the intersection of judicial independence and partisan politics within the Ohio court system.
