DOJ Seeks Emergency Injunction to Halt Processing of Certain California Ballots

The U.S. Department of Justice has filed an emergency request in federal court, seeking to prevent California election officials from tabulating mail-in ballots cast by approximately 20,000 individuals. Federal authorities allege these voters are likely noncitizens and therefore ineligible to participate in federal elections. This legal maneuver follows a series of escalating tensions between the Trump administration and California state officials regarding the integrity of the state's voter rolls.

Earlier this month, the Justice Department provided California with a list of names and issued a 48-hour ultimatum for state and local officials to verify the citizenship status of those listed. When state authorities declined to comply with the demand, the federal government initiated a lawsuit. Acting Deputy Attorney General Trent McCotter has maintained that the department will not permit noncitizens to influence federal election outcomes, warning that officials could face potential criminal consequences for processing these specific ballots.

California officials have pushed back against the federal demands, characterizing the actions as an attempt to undermine a free and fair electoral process. State representatives have requested detailed documentation explaining the methodology used by the federal government to identify the individuals on the list, noting that they have yet to receive a satisfactory explanation. Critics of the DOJ's approach have described the move as an unprecedented intervention, particularly given that voting is already underway.

In addition to the request for a temporary restraining order, the Justice Department recently announced that it has brought charges against 28 individuals in California for alleged election crimes. This development has further intensified the ongoing dispute, which appears likely to persist through Election Day. As the legal battle unfolds in the U.S. District Court for the Central District of California, the state continues to process ballots while the court considers the federal government's request for emergency relief.
